Employer Counseling and Claim Prevention
Employers want to treat their employees fairly and in compliance with legal requirements; however, many are wary of the seemingly endless tangle of legal constraints and of being sued by under-performing or incapable employees who may not take responsibility for their own shortcomings. As experienced litigators, we know what preventative measures employers can take in managing their businesses to minimize the risks of employment claims and expensive litigation.

Wrongful Termination, Civil Rights and other Employment Litigation
We litigate in federal and state court in all areas of employment law, including sexual harassment, wrongful termination, employment discrimination and retaliation, negligent hiring/retention/supervision, workplace violence, workplace privacy, employee leave laws, reductions-in-force and WARN Act, breach of express or implied contract, defamation, wage and hour, contract, trade secret misappropriation and enforcement of restrictive covenants. We also represent clients before government agencies such as the California Department of Fair Employment and Housing, California Labor Commissioner's Division of Labor Standards Enforcement, California Unemployment Insurance Appeals Board, Federal Equal Employment Opportunity Commission and Department of Labor. Our team of results-driven employment lawyers are experienced in court, jury and arbitration trials. We are also skilled at resolving cases through motions practice when appropriate and cost-effective. We examine the feasibility of settlement or alternative dispute resolution initially and then throughout the litigation. We are successful in early mediation and arbitration as a means to reduce jury risk and attorneys' fees, and to accelerate disposition of claims.
Business Transactions and Major Organizational Changes
When businesses are bought, sold or restructured, employment law issues arise. We help businesses reduce the chances that employees who are displaced or reassigned in these transactions will resist or sue over those changes. We help buyers and sellers structure transactions, including negotiating and drafting representations and warranties regarding, and allocation of potential liability for, workplace and employee problems. We also counsel employers on reductions-in-force and plant closings under the WARN Act and other laws, and mass hiring issues that may result from a transaction or business necessity.
