Message from the Firm

Employers really need to be on their toes these days. Just when we think we can breathe a sigh of relief that 1999 will close with a well managed work force with few or no employee claims to defend, the landscape changes with new laws. While the many pro-employee bills that drew a veto from the Governor as too burdensome for California employers did not get much attention, it still seems that employee rights are being expanded at a greater pace than in years past. In this issue, we review the restoration of daily overtime, and expansion of employee leave and antidiscrimination rightsÑall of which will become law on January 1, 2000. Consequently, employers will have to increase their efforts to make careful hiring decisions, treat employees fairly while expecting productivity, train personnel to avoid and end unlawful behavior, and to keep up on new laws.

We also address in this issue one way some employers try to isolate themselves from employment claimsÑemployee leasing. While an employee leasing company can help improve employment practices at a company, it does not provide the kind of insulation from claims that some suggest.
